Probate is the process by which a deceased person's assets sometimes known as their "estate" are legally managed. You should not make any decisions or put any property for sale before applying up for probate.
Getting a probate
You need to apply to the probate registry England to get probate. Prior to applying, you must:
• whether you meet the requirements for the application, whether a probate is necessary, and whether you must pay inheritance tax, and check to see if a probate is needed.
• Contact the financial organizations the deceased person used such as their bank and mortgage company to see whether you need to go through the probate process in order to access their assets. If the decedent fits any of the above descriptions:
• Unless the surviving owners have agreed differently, only owned savings owned stock or cash with others; this immediately transfers to the surviving owners; owned land or property as tenants and this automatically transfers to the living owners.
• Find out if you are eligible to apply for probate through probate registry Kent. Only some people are eligible to apply for probate. Who may apply depends on whether or not there is a will. The executors who are named in a will may apply. If there is no will, the closest living relative may apply.
• Assess the estate's value to determine inheritance tax. Before requesting probate, you must discover whether you must pay inheritance tax. To do this, you must assess the estate of the deceased person. Even if there is no tax owed, you must include the value as part of your probate application.
